1. Definitions
– Customer/User: Refers to the individual or entity using the RentNow platform to book a rental service (car, home, bike, or scooter).
– Host: Refers to the individual or entity that provides rental services via RentNow, such as car rentals, homes, bikes, or scooters.
– Platform: Refers to the RentNow website and mobile application.

2. Ownership of the Platform
– RentNow owns and operates the platform, which is protected under Albanian law, particularly Law No. 35/2016 “On Copyright and Other Related Rights”, as amended.
– Unauthorized reproduction, distribution, or use of the platform’s content without prior written permission is prohibited.
– Any violation of Albanian legislation on intellectual property rights will result in legal action.

3. Contractual Relationship with Hosts
– RentNow acts as an intermediary between customers and hosts. The rental agreement is made directly between the customer and the host.
– RentNow is not a contractual party to any rental transaction. Any legal agreements, terms, and conditions are between the customer and the host.
– All communication between customers and hosts should take place through the RentNow platform to ensure proper record-keeping and customer support.

4. Reservation Policies
– RentNow facilitates the reservation process between customers and hosts.
– Reservations are automatically approved to ensure fast and seamless booking experiences for users. Once a reservation is made, the host is immediately notified, and the booking is confirmed.
– RentNow encourages hosts to regularly update their availability to avoid double bookings or other conflicts.
– The host determines cancellation policies. RentNow does not take responsibility for cancellations or modifications made by the customer or host.

5. User Responsibilities
By using the RentNow platform, you agree to the following:
– Accurate Information: You will provide accurate personal information when creating an account and making bookings.
– Compliance: You will comply with all relevant local, national, and international laws and regulations while using the platform.
– Respectful Use: You will not engage in any activity that may harm or interfere with the functioning of the platform, including but not limited to hacking, spreading malware, or misusing the platform’s features.

6. Host Responsibilities
Hosts agree to:
– Maintain Accurate Listings: Keep their rental listings up-to-date with accurate information, pricing, and availability.
– Timely Communication: Respond to customer inquiries and bookings within a reasonable timeframe.
– Comply with Regulations: Ensure that all vehicles, homes, bikes, or scooters meet the necessary legal requirements and safety standards.
– No Sharing of Contact Information Before Payment: To ensure RentNow can continue running the platform efficiently, hosts are prohibited from sharing direct contact information with users before payment is made through the platform. This ensures the booking commission, which helps maintain the platform, is correctly applied. If a host is found to violate this rule:
      – First Offense: The host will be notified and reminded of the platform policies.
      – Second Offense: The host’s account will be banned from the platform.

7. Payment & Fees
– Payments for rentals are processed through the RentNow platform. Hosts may specify their pricing and any additional charges (such as delivery fees or deposits).
– RentNow charges a service fee, which is included in the final price at the time of booking.
– Customers will be responsible for paying any applicable taxes, fees, or other charges associated with their rental booking.

8. Modifications & Cancellations
– Hosts: Can modify or cancel reservations based on their stated policies. Any fees or penalties for cancellations are determined by the host.
– Customers: Are responsible for reviewing the cancellation policies of each host before confirming a booking.
– RentNow: Does not take responsibility for cancellations, modifications, or refund disputes between the customer and the host.

9. Liability
– RentNow acts solely as a facilitator and intermediary and is not responsible for the condition of the rented vehicles, homes, bikes, or scooters.
– RentNow does not guarantee the availability or quality of rental services provided by hosts.
– Any disputes arising from the rental transaction must be resolved between the customer and the host. RentNow can assist with mediation but does not take responsibility for resolving disputes.

10. Changes to Terms
– RentNow reserves the right to modify these Terms of Service at any time. We will notify users of any significant changes, and continued use of the platform after such changes are posted will constitute acceptance of the updated terms.

11. Governing Law
– These Terms of Service are governed by and construed under Albanian law. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts in Albania.
